Tarion coverage on an Ontario house runs seven years on major structural defects, two for the envelope and mechanical systems and one for workmanship and materials, counted from first occupancy, and whatever remains passes to a later buyer. Ask for the enrolment number plus any open claims. HST is built into a builder's price and the rebate is normally assigned to the builder when the home is your primary residence; on a resale of a recent home the seller has already paid it, so no HST applies. Assignment sales, where the original buyer sells a contract before closing, carry different HST and deposit rules and need a lawyer familiar with them. Confirm the lot grading has been certified and the driveway and sod are done, since some builders close before the exterior is finished, and check for development charge clauses and adjustments on closing.
